Terms of service – revised August 2021
The following terms of service apply between “the photographer” Simon Dopson and the client.
Images
Photographs during the event will be taken at the discretion of the photographer. Every effort will be made to capture any specific shots requested by the client however no guarantees can be made. The photographer cannot accept responsibility for any restrictions at the venue, changes in weather or willingness of subjects. The client may prepare a list of photographs they are after, such as group shots, however someone familiar with the guests will need to assist, e.g. a master of ceremonies. For certain venues, e.g. church services, the photographer’s movements may be restricted by the official in charge, for this the photographer cannot accept responsibility for any the limitations in photographs captured.
Copyright
Copyright of all images remains that of the photographer. Once the images have been passed to the client you are welcome to use them for personal use anywhere, e.g. social media, prints, sharing with friends or family.
For anyone wishing to use the photos for commercial purposes, for example the venue or supplier posting on social media, please inform the photographer and ensure the photos are credited to “Simon Dopson Photography”.

Use by the photographer
If the client has agreed, the photographer may use the photographs for marketing purposes online, i.e. social media and their website. The photos selected will be those of the client. Photos consisting ONLY of guests, or any young children, will not be used in the interest of their privacy. Photos will not be used until the client has received their first copy.
Cancellation
If the client wishes to cancel the photographer, and has already paid a deposit, a £1.00 cancellation fee will apply. The remaining deposit will be refunded. If the cancellation is made less than 7 days before the event, a cancellation fee of 10% of the agreed total fee will apply. The remaining balance will be refunded within 7 days from notice of the cancellation, assuming bank details have been received. If the client requires to postpone the event, and the photographer is available on the new date, no adjustment fee will apply. If the photographer is unavailable on the new date, the cancellation fee will apply as above.
Force Majeure
In the unlikely event of cancellation by the photographer, liability shall be limited to a full refund of any payments made, and best efforts will be made to put clients in touch with another photographer. As with most small businesses reasons for cancellation may include, but not limited to; sudden illness, injury, victim of crime, natural disaster, vehicle or equipment breakdown.
The photographer will carry two sets of equipment at the event, both with backup storage, to mitigate any equipment breakdown risk.

On the day
The photographer will aim to be at the venue at least 30 minutes before the requested time to allow for traffic and setup of equipment. The photographer will, wherever possible, freely move around the venue capturing candid shots of the client and guests. Please do not hesitate to approach/engage the photographer on the day with any special request etc.
The photographer will not take photos while guests are sat down to eat, with the exception of speeches and cake cutting, and will use this time to take a break. A full meal is not a requirement, however something small to eat would be appreciated during this time.

The photographer is covered by AXA’s public liability insurance. Details of which are available on request.
Delivery
The photographer will aim to have digital copies available online within 2 weeks (usually between 100 and 200 images).
Those, plus additional photos from the event, will aim to be sent on USB memory stick within 4 weeks.

Personal Data
The client’s data has been collected for the purposes of photographing their event. This includes name, e-mail address, contact number, postal address (for sending the physical photos), and bank details (for purposes of refunds). Data is held for these purposes only and will never be sold or shared with anyone.
The photographer will retain a copy of all photographs from the client’s event for at least two years unless it is requested in writing to remove them sooner. Data held on the client is available on request.
